We appreciate your confidence and we take on your rights very seriously. It is of paramount importance that you are aware of what you can expect from us and that we know what to expect from you.

The terms and conditions of sale below will make clear what your legal situation is each time you visit our website and each time you purchase at Slaapcomfort-center. By entering our website you agree to comply with the legal commitment and the stipulations and conditions below and on this site. You are free to print these terms and conditions of sale.

All articles offered by Slaapcomfort-center are as complete as possible and are described in good faith. The special offers and prices are valid on the day they have been offered on our website and for the period indicated in our catalogue and leaflet. The indicated prices are VAT included. The shipment costs depend on the type of article. We would like to refer to our table with shipment costs in the
help menu, further below.

Slaapcomfort-center is doing its utter best to make sure that the ordered goods reach you as soon as possible.

Placing an order is very easy. You have a couple of possibilities:

After having chosen which product you want to order, you click the Order now button. The following steps are indicated in your shopping cart on this site.
As a new customer you will have to enter your address. After having confirmed the order you will receive an automatic confirmation by e-mail.

All products sold by Slaapcomfort-Center can be seen and bought on the website https://www.slaapcomfort-center.be or in our show room in Heist-op-den-Berg.

All products offered are identified with a reference number, which should always be mentioned if you contact Slaapcomfort-center.

Slaapcomfort-center cannot be held responsible for possible (printing) errors concerning the content and the product price which occur in the special offers, which have not yet been adapted on the website at the moment the customer has visited the site with the intention to buy something.

In case a product is no longer available or in case of a special offer, the client will be informed by e-mail or by phone. If the customer has not paid yet, the customer can cancel the purchase without delay. If the customer has already paid, the customer can either choose to exchange the product for another one or to get a refund.

Slaapcomfort-center cannot be held liable for any damages which might occur due to a product not being available anymore.

Because Google and other search engines save successful messages for quite a while, it might happen that you land on an out-of-date page of Slaapcomfort-center when you search with one of those search engines. There is a chance that the data (both content and price) no longer correspond with reality. Slaapcomfort-center cannot be held liable for this. To find up-to-date publications you should directly visit the website of Slaapcomfort-center.

The prices on the site are always VAT 21 % inclusive.

There is a valid agreement between you and Slaapcomfort-center 24 hours after Slaapcomfort-center has received the order on its website or when Slaapcomfort-center has received your validly filled in order form. As soon as there has been a test placing, the agreement is also valid.

However, Slaapcomfort-center can decide to submit the agreement's validity to other conditions, in case of important orders or advance payments, orders put in by minors, in case the order form is incomplete or inaccurately filled in, or in case preceding orders have not been paid for.

The Slaapcomfort-center products can be booked by phone, by e-mail or directly online through the Slaapcomfort-center website.

After having concluded a purchase the customer will receive an e-mail of Slaapcomfort-center with the order confirmation and an invitation to transfer the money or to pay with a credit card.

Bosmans Slaapcomfort-center accepts payments with Visa, Master Card, American Express and by remittance.

Slaapcomfort-center cannot be held responsible for any delay, damages and/or loss of the documents as from the moment Slaapcomfort-center has delivered these documents to the post.

The orders are either sent by priority mail or by UPS courier service.

The customer and buyer declare to be older than 18 years.

In case you do not pay the product you ordered, you will receive a reminder mail after 7 days. There will be sent 3 reminders at the most. If you do not pay after the third reminder, your order will be cancelled.

We always send and prepare the orders with great care. Should you, despite our care, receive a seriously damaged order, then you can exchange it. The exchange will happen after we have received the originally sent article voucher in the Slaapcomfort-center office, accompanied by a copy of the invoice.

The Belgian law concerning trading practices and the information and protection of the consumer of 14 July 1991 allows the purchaser to inform the seller he abandons the purchase within 7 working days counting from the ordering of the product. Therefore you have the right to send your order back within 7 days after having received your product (in the original and unopened packing). Should you desire to send a product back because you have changed your mind, you can do so within 7 days after having received the product. We will refund your order within 15 days.

Payment with your credit card
We accept Visa/Eurocard, Master Card and American Express. You can introduce the information concerning your credit card on line. Your card will only be debited at the time of the shipment of the goods. Paying with your credit card on the Slaapcomfort-center website is completely safe.
Payment by cheque
You can also pay by sending us a cheque or by transferring the amount (before the shipment of the goods) if you are located in a Benelux country, France or Germany. Please make the payment with the structured communication which is mentioned in the confirmation e-mail you received from us. As soon as we have received the payment, the goods will be sent immediately.
Payment by transfer
After the registration of your payment we will immediately send you the goods. Both in Belgium, the Netherlands and the EU. The shipment of the goods is done by post or with the courier service of UPS.

Payment of the goods (in stock) which will be delivered by our courier service

You place your order at Slaapcomfort-center and you will receive an order confirmation by e-mail.
These goods can also be paid for with your credit card (online) when you order, but that is not an
obligation.
You will soon be contacted to set a delivery date. It is needless to say that if your order cannot be executed for some reason or another, the prepaid
sum will be refunded immediately.
In case you have not yet paid, the goods must be paid at delivery.

Payment of the goods (not in stock) which will be delivered by our courier service

You place your order at Slaapcomfort-center and you will receive an order confirmation by e-mail.
In our confirmation mail we request you to transfer an advance payment of 10% to our account.
After having received your advance, the article will be ordered at our supplier.
As soon as we can deliver, we will contact you to set up an appointment.
In case the goods have not yet been paid for, they must be paid for at the time of delivery according to the agreement mentioned on the official ordering form of this website and on our account.

Delivery of your product

The products will be delivered to the location you mentioned on the order form.

The risk of damage and/or loss is only at the expense of Slaapcomfort-center until the moment of shipment to the customer.

The time of delivery is mentioned on the confirmation coupon we always send to the customer.

Slaapcomfort-center does its utmost to make sure you receive your product in accordance with the period mentioned on our website. These delivery periods are only informative and Slaapcomfort-center cannot be held liable for possible delays.

Articles which are in stock are indicated on the site as 'sent immediately'. The expected delivery period of non-stock items is indicated on the site.

The delivery periods on our site are indicative. We can deal with the majority of the orders within the expected delivery period. But we can never exclude exceptions. As soon as we receive an article of your order, we will send it to you. At that moment you will receive a shipment confirmation of Slaapcomfort-center.

In exceptional cases it is possible that you receive your order somewhat later due to delays at the post office. In case you have not received your package after a while, you can turn to your local post office. Orders from Euro 35 will be delivered by courier service.

The package(s) will be offered two times at the mentioned delivery address. When no one is present two times, the client has to call for the package himself at the depot of the courier service. The package can be offered once again by the courier service provided that a supplementary shipping cost will be paid in advance.
In accordance with our terms and conditions of sale, Slaapcomfort-center cannot be held liable for possible delays, damages and/or loss as from the moment of shipment.

The delivered products should be free of any defects. Possible damages should be immediately reported to the seller by registered mail. Visual damages must be reported when receiving the goods.
Hidden defects are subject to the law of 1641-1649 B.W.: the seller cannot be held responsible for hidden defects after a period of 6 months after delivery.

After having received the ordered product you are entitled to dissolve the underlying agreement with Bosmans Slaapcomfort-center within 7 days. Should you desire to dissolve the sale (*), you must inform us in writing (by mail, fax or letter). After our consent you can send the product concerned back to us. The product must be in our hands not later than the 7th working day after invoice date.
The payments you have already made will be refunded onto your account, except shipment costs, within 14 days.

(*) In order to return the goods, the following conditions must be observed:

The delivered products must still be 100% saleable. The products must be free of any signs of having been used. The packaging must also be intact. The accompanying documents (guarantee certificates ...) must also be returned.
Bosmans Slaapcomfort-center reserves the right to refuse returned products or to refund only part of the amount if the above mentioned conditions are not complied with.
Return shipments are not accepted for made to measure products and products which were bought during a promotion action.
This possibility to return goods is only valid for articles which were bought online, and not for the delivery of mattresses, bed boards ... by our services. Those are subject to the normal terms and conditions of sale which are mentioned on the official order form of Bosmans Slaapcomfort-center.
This possibility to return goods cannot be seen as a trial or testing period.

Slaapcomfort-center cannot guarantee that https://www.slaapcomfort-center.be will function uninterrupted or impeccably. Slaapcomfort-center does not provide any guarantees concerning the results which can be obtained by using https://www.slaapcomfort-center.be nor for the correctness or reliability of the information obtained at https://www.slaapcomfort-center.be.
This site is put at your disposal by Slaapcomfort-center on an 'as is' and 'as available' basis.
Slaapcomfort-center does not make any statements or does not give any guarantee, clearly or implicitly, concerning the functioning of the website, the information, the content, the materials or the products which are presented on the site. As far as legislation allows it, Slaapcomfort-center rejects any guarantee, clearly or implicitly, enclosing but not restricted to implicit guarantees of saleability

GUARANTEE

Each product (mattress, bed base) has a warranty as foreseen from the brand. This period can be different and this depends only on the requirements from the responsive brand. Each motor from bedbase has a legal 2 years guarantee.

Belgian law is always applicable. Only the law courts of the judicial district of Malines are qualified.

Bosmans slaapcomfort is member of beCommerce and has to follow the code of conduct as foreseen.

Minors cannot conclude an internet agreement at Slaapcomfort-center and we advise parents or guardians to check the internet use of minors.

The buyer is obligated to pay the purchase price within 7 working days after having received the goods. The buyer is not qualified to deduct any amount from this purchasing price as a counterclaim.
In case the buyer does not meet the payment obligation and does not act upon the proof of default with a one week's term, the seller is entitled to consider the sales agreement as dissolved without any judicial intervention. In that case the buyer is liable for the damage done to the seller, among which loss of profit, shipment costs and costs for the proof of default.
If the seller undertakes judicial or extrajudicial measures in case of default, the seller has to pay the costs. These costs amount to at least 10% of the invoice amount with a minimum of € 400.

A delivery of the goods with enclosed invoice must be protested by means of a registered mail within 7 days after receiving the goods.
In any case of dispute of non-payment only the court of commercial law of Malines and/or the Justice of the peace court of Heist-op-den-Berg are qualified. And the goods remain in the possession of Slaapcomfort-center Bosmans until the invoice has entirely been paid for.

Just as with payments in the physical world, where you can fall victim to fraud, the security of paying on the internet is largely in your own hands.

This is what you can do yourself:
Always keep your PIN codes and passwords a secret
Protect your computer with a good firewall and virus scanner
Make sure you use a secured page to make payments or to look at your transaction surveys. A secured page uses a https:// address instead of a https:// address and there is a lock or a key in the status bar
If you pay after having received your goods, there is no risk that you will not receive the ordered product
If you do not trust a web shop, then do not buy anything there. You would not do so in real life as well

Credit card

Most internet fraud using credit cards is committed with data which were stolen physically, i.e. in a store or restaurant. There are also special programs to create credit card numbers. That can be your number by accident. But nowadays you always have to provide the three digit CVC code, which you can find on the signature strip, when you make a payment. Those programs cannot create that code.
Nevertheless you do not need to worry about losing your money if somebody has abused your credit card data on the internet. Every credit card company uses the charge back: if you dispute a payment, then your money will be refunded immediately.

In case the order has already been paid for and has already been sent to the customer, the paid amount will be refunded to the customer after having received the returned goods.

Refunds are only paid onto the account number of the person who made the payment, being the buyer.

Refunds to the customer will be executed within 30 day after having received the customer's payment.

Refunds of payments made by credit card will only be executed after the amount paid by the customer has been transferred to the account of Bosmans Slaapcomfort-center by Bank Card Company. This can take up to three months.

Annulment and refunding of a product made to measure is not possible.

Which data do we collect? How do we use it?
